Refund Policy

All purchases are covered by our standard 60 day money back guarantee. Refunds for purchases made by credit card will be credited to the card used for the original payment. A credit note may be issued for payments made by cheque or bank transfer.

Physical products should be shipped back to The Confusion Clinic Limited, 105 White Lane, Sheffield, S12 3GE United Kingdom. Products can be returned in any condition. Your refund will be processed once we receive the product, but you must notify us within 60 days of purchase of your decision to return the product.

Terms and Conditions

These are the terms and conditions of THE CONFUSION CLINIC trading as THE CONFUSION CLINIC LIMITED (“The Confusion Clinic”) which means The Confusion Clinic Limited of 105 White Lane, Sheffield, South Yorkshire, UK, S12 3GE trading as a limited company.

Definitions

“Agreement” – the contract for Services to be provided by The Confusion Clinic to The Client.

“The Client” – the company, business, other corporate entity or individual in receipt of Services from The Confusion Clinic.

“Commencement Date” – the date of the Agreement.

“Proposal” – The fee quote provided by The Confusion Clinic to The Client.

“Services” – The agreed services that are to be provided by The Confusion Clinic to The Client pursuant to the Agreement.

General

A. The Confusion Clinic will commence provision of the Services upon receipt of confirmation from The Client that these terms of conditions are accepted, either by e-mail, telephone, post or fax.

B. Where a client is an individual The Confusion Clinic will only carry out for those individuals who are over eighteen years of age and in signing this agreement you warrant that you are over eighteen years of age.

C. Where The Client is a company, business or other corporate entity, the person who signs the Agreement confirms that they have the required authority to enter into an Agreement with The Confusion Clinic on behalf of that company, business or other corporate entity.

1. Exclusivity

The Confusion Clinic agrees to work exclusively for The Client within the sector or geographical region as defined in this Agreement. Any additional restrictions will be agreed between The Confusion Clinic and The Client in writing prior to acceptance of this Agreement.

2. Guarantee

2.1 The Confusion Clinic does not provide any guarantee as to the results that The Client may achieve from the Services.

2.2 For Google-related campaigns The Client warrants that their website complies with Google’s terms of service. If The Client’s website does not comply with Google’s terms of service, The Confusion Clinic is unable to provide Services to The Client. Should The Client be in breach of this clause 2.2, the Agreement shall terminate immediately and all fees that have been paid and that are payable by The Client pursuant to the Agreement shall be forfeited by The Client.

3. Money Back Guarantee

The Confusion Clinic will refund the full amount of their fees if the client notifies The Confusion Clinic of dissatisfaction with the services provided by The Confusion Clinic within sixty days of the work required under this agreement being commenced PROVIDE ALWAYS that the information provided by the client to The Confusion Clinic prior to entering into any contract and regarding existing website conversion figures is correct.

4. Availability

The Confusion Clinic’s operational hours are from 9.00am to 5.00pm UK time and services will only be rendered outside this time by appointment. Weekends and public holidays are excluded and there may be other times when The Confusion Clinic’s service is unavailable and The Confusion Clinic will notify the client of those times in advance.

5. Fees

5.1 The fees payable are as outlined in the proposal supplied or communicated to the client by The Confusion Clinic and remain valid for thirty days from the date of that proposal, after which time a new proposal should be requested by the client.

5.2 Consultation and training fees must be paid in advance of any consultation or training session. Monthly retainers are payable monthly in advance on seven day terms. Should a payment not be received within seven days of the invoice date work will be paused until the account is up to date.

5.3 All other projects are billed as agreed in writing. Seven day terms apply to all invoiced payments.

6. Additional Charges

The Confusion Clinic will always contact the client at the earliest possible opportunity to discuss any additional charges that may be incurred in carrying out any work.

7. Cancellation

You have the right to cancel this agreement at any time, subject to payment of all charges already billed. Cancellation must be given in writing or verbally.

8. Limitation of Liability

The liability of The Confusion Clinic for any losses incurred by the client is limited to the value of the work carried out and the client hereby indemnifies The Confusion Clinic against the cost of any claims made arising out of any breach by the client of the terms of this agreement.

9. Retention of Title

All work carried out by The Confusion Clinic remains the property of The Confusion Clinic until paid for.

10. Loss of Business

In no event shall The Confusion Clinic be liable to the client for any loss of business, loss of opportunity or loss of profits or for any other indirect or consequential loss or damage, irrespective of circumstance.

11. Force Majeure

The Confusion Clinic shall not be responsible for failing to comply with the terms of this agreement due to circumstances beyond their control. Such circumstances may include but are not limited to war, civil disturbance, fire, earthquake, flood and other naturally occurring event.

12. Jurisdiction

This Agreement is governed by the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction over its interpretation.

13. Entire Agreement

This agreement and any documents referred to within it constitute the entire agreement between The Confusion Clinic and the client and may not be varied unless otherwise in writing and signed by both parties. Should any clause be found to be illegal or unenforceable then this will not affect the validity of the rest of the agreement.

14. Consumer Protection (Distant Selling) Regulations 2000

The client, if an individual, may have the right to withdraw from this contract without charge within fourteen working days. However, if The Confusion Clinic have begun work during that time with the client’s consent that right is lost. Acceptance of these of terms and conditions constitutes such consent.
